Limited Warranty

Effective August, 2009

Enhanced Defense Sprays, LLC warrants that the purchased unit shall be free from defects in materials and workmanship for a period of three years from date of purchase and will replace, without charge, any merchandise proved defective in material or workmanship which arise within that timeframe to the original purchaser. The shelf life of the product expires four years past the production date marked on the unit. The product should be discarded after that shelf life expiration timeframe in an environmentally respectful manner in accordance with the local, state and federal waste management jurisdiction mandate.

Any implied warranties, including those of merchantability or fitness for a particular purpose are also limited to the aforementioned timeframe. Any action must be commenced within 60 days following the three year warranty period starting from the date of purchase. Enhanced Defense Sprays, LLC obligation under this warranty is limited to replacement of the defective unit which is returned to Enhanced Defense Sprays, LLC within 60 days following the 3 year warranty period. Enhanced Defense Sprays, LLC assumes no risk and shall be subject to no liability for damages or loss resulting from the specific use or application made of the Products. Enhanced Defense Sprays, LLC’s liability for any claim, whether based on breach of contract, negligence, infringement of any rights of any party or product liability, relating to the products shall not exceed the price paid by the Distributor or Purchaser to Enhanced Defense Sprays, LLC for such products. Under no circumstance shall Enhanced Defense Sprays, LLC be responsible for any special, incidental or consequential damages with respect to economic loss, loss of use, loss of profit, claims of third parties, or injury to person or property, however caused, whether as a result of breach of express or implied warranty, negligence, or otherwise.

Exceptions and Terms to this warranty are as follows: modification, alteration, misuse, abuse or customization of Enhanced Defense Sprays, LLC products voids all warranties and return rights. Removal of production date marks and other inventory/product control measures or mechanisms voids the warranty. Failure to follow the Care, Maintenance and Storage instructions provided with the unit packaging voids the warranty. Items under warranty may be replaced with matching like new items. Enhanced Defense Sprays, LLC will not be responsible for the result of careless handling or unreasonable or illegal use. Read the abbreviated enclosed retail packaging instructions and the detailed web store instructions. The above remedy is exclusive and shall not apply if the unit has been subject to misuse or abuse. This warranty gives you specific rights, and you may also have other rights which vary from state to state. Some states do not allow time limitations on an implied warranty, or the exclusion or limitation of incidental or consequential damage, so the above exclusions may not apply to you.

In the event of a product recall action, EDS and our distributors reserve the right to make contact with you for the purpose of remedy with the address noted on the sales receipt. This contact information must be kept current and is the responsibility of the purchaser to keep EDS notified. If your address is non-permanent the online web store should be checked for Recall Notice postings.

This Terms, Conditions and Notice of Use document should be read in conjunction with the Limited Warranty, Store Policy, Return Policy, Consumer Agreement and Privacy Policy Statement for a comprehensive overview of your responsibilities. The web site should be reviewed for update postings, and detailed Instructions: Directions, First-Aid Measures, Care, Maintenance & Storage and all other documents, etc. prior to use of a product. In addition, the abbreviated instructions, Retail Packaging Insert Card Instructions enclosed within the retail packaging should be read and understood prior to use.
